US EIN for Indian founders: what to prepare before applying

Understand the IRS’s free EIN process, online eligibility and why entity formation and ongoing filings are separate.

The quick answer

An EIN is a US federal tax identification number issued by the IRS. Issuance is free. Indian nationality alone does not decide the application route: online eligibility also depends on the entity, principal place of business and the responsible party’s SSN or ITIN.

Separate formation from the tax identifier

If you are creating a corporation or LLC, the IRS says to form the entity through the relevant state first, then apply for the EIN. Keep the entity’s exact legal name and formation record ready so the application can be consistent with those records.

Put the administrative steps into separate rows in your plan: state formation, federal identification, banking preparation and ongoing filing review. Completing one row should not automatically mark the others complete. An EIN confirmation letter identifies a tax number; it is not a complete operating or compliance plan.

Check the online route before starting

The IRS’s online eligibility guidance includes a domestic organisation formed in the US or its territories, a US principal place of business, and the responsible party’s SSN or ITIN. It also requires an appropriate responsible party or authorised representative. Check the actual entity and people against those conditions.

If online eligibility is not met, consult the current Form SS-4 instructions for the appropriate application method. Those instructions distinguish other routes and the circumstances for international applicants. Avoid assuming that living in India automatically makes every telephone or online route available.

Prepare an application brief from your records

Use the live SS-4 form and instructions to confirm what each field means. A short internal brief helps keep information consistent, but it should not substitute for the form. Keep identity information in secure records and enter it only through the official process or an appropriately authorised adviser.

  • Exact legal name and entity type, checked against the formation records.
  • Mailing and principal business address information.
  • The responsible party and applicable identifying information.
  • Reason for applying and relevant business start information.
  • Expected business activity and employment details as requested.
  • Any required authorisation if someone else will apply or receive information.

Keep the letter, then review ongoing obligations

The IRS does not charge an EIN issuance fee. If you engage a professional, ask what any separate professional fee covers, which route will be used and who will receive the confirmation. Keep the final IRS letter with the entity’s records.

Plan a separate review of US tax and information returns and the Indian implications of ownership, funding and activity. Those requirements depend on the entity and transactions. Do not rely on an EIN article to settle filing duties, bank eligibility, immigration status or the treatment of a cross-border transfer. The useful outcome here is a clear application brief and an identified next step.
